Terms of Service for Hypa

These Terms of Service (“Terms”) govern your use of the Hypa platform and services, including the website, web app, and any related mobile experiences (collectively, the “Service”).
By accessing or using Hypa, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Who Can Use Hypa
To use Hypa, you must:
- Be at least 16 years old
- Have the authority to bind your gym or fitness business to this agreement
- Use our Service only for lawful purposes
2. Your Hypa Account
You are responsible for:
- Keeping your login credentials secure
- Ensuring that your staff and users comply with these Terms
- The activity that occurs under your account
We may suspend access if we detect unauthorized or suspicious use.
3. Your Data
You own all content and data (e.g., member information, class schedules, business details) you input into the Service.
By using Hypa, you grant us a limited license to process this data to operate and improve the Service, in accordance with our Privacy Policy.
4. Payments
- Hypa enables you to sell memberships and accept payments via integrated payment processors (e.g., Paystack).
- We charge a transaction fee per paid membership based on your selected plan.
- Premium features may require a subscription or usage-based payment.
- You are responsible for setting your pricing and handling refunds to your customers.
5. Prohibited Use
You may not use Hypa to:
- Violate any local or international law
- Engage in fraudulent or deceptive practices
- Upload harmful, illegal, or offensive content
- Interfere with the Service's integrity or security
6. Intellectual Property
All software, branding, and materials provided through Hypa remain our property or that of our licensors. You may not copy, reverse engineer, or commercially exploit any part of Hypa without our written consent.
7. Termination
We reserve the right to suspend or terminate your access at any time if you violate these Terms or misuse the Service.
You may also cancel your account at any time. Upon cancellation, your access will be revoked, and your data will be handled in accordance with our data retention policy.
8. Limitation of Liability
To the fullest extent permitted by Ghanaian law:
- Hypa is provided “as is” and “as available.”
- We are not liable for any indirect, incidental, or consequential damages, including loss of revenue or data.
- Our total liability will not exceed the amount you've paid to us in the previous 6 months.
9. Indemnity
You agree to indemnify and hold us harmless from any claims, damages, or liabilities arising from your use of the Service or your breach of these Terms.
10. Governing Law
These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be resolved through amicable negotiation or referred to arbitration in Accra, Ghana.
11. Changes to Terms
We may update these Terms at any time. Material changes will be communicated via email or notice in the app. Continued use of Hypa after changes means you accept the updated Terms.
